The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The parties agree that a party may bring claims against the other only in each one's individual capacity, and not as a plaintiff or class member in any putative class, collective and/ or representative proceeding, such as in the form of a private attorney general action against the other. Further, unless both you and A Cup of Rainbows agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

You knowingly, voluntarily and expressly waive any right to claim against the Publisher (Holly Tate), the Siteacupofrainbows.com), the Company (Holly Tate dba A Cup of Rainbows), A Cup of Rainbows assistants or contractors providing the Services listed on our Site, and all facilities where A Cup of Rainbows operates (including Holly Tate’s home at 5032 Wana Court Mableton, GA 30126, The Lutheran Church of the Nativity 2450 Clay Rd, Austell GA, and ALL other facilities which host our Services) for any illness, injury or death to any participant, property damage or loss of any kind, caused by my voluntary participation in lessons.

This is a legally binding Waiver, Release, Discharge and Covenant Not to Sue the Publisher (Holly Tate), the Site (acupofrainbows.com), the Company (Holly Tate dba A Cup of Rainbows), any and all assistants or contractors hired by or affiliated with A Cup of Rainbows in any regard, and all facilities where A Cup of Rainbows operates (including Holly Tate’s home at 5032 Wana Court Mableton, GA 30126 and ALL other facilities which host our Services).
